Terms of Service

These terms cover xenaproduction.com and the video work Xena Production LLC (“Xena Production”, “we”, “us”) does for clients. By using the site or working with us, you agree to them.

The website

You are welcome to browse and share the site. The films and frames shown belong to us or to the clients they were made for, so please do not copy or reuse them without permission. Embedded videos play through YouTube and Vimeo under those services’ own terms.

Our services

We make launch videos and product explainers, and provide motion design, editing, colour grading and 3D product animation. The scope, deliverables, timeline and fee for each project are set out in a written proposal or statement of work. Where that document and these terms differ, the document applies.

What we need from you

  • Accurate information about the product, its audience and the launch, and the assets the work needs.
  • The rights to any footage, brand assets or other material you give us.
  • Feedback and approvals in good time, so the schedule holds.
  • Payment as agreed in the proposal.

Who owns what

  • Your material stays yours. You give us a limited licence to use it only to make your project.
  • Once you have paid in full, you own the final files made for you: the rendered film, its cuts and the exports in the agreed formats.
  • Working files, such as After Effects, Premiere Pro, DaVinci Resolve and Blender projects, stay ours unless we agree in writing to hand them over, which may be charged separately.
  • Our tools, templates, presets and methods stay ours.
  • We may show finished work on our website, social channels and in our pitches, unless a written non-disclosure agreement says otherwise. Tell us before the project starts if the work must stay private.

Payment

  • Fees and schedule are set in the proposal. Our usual split is 50% before work starts and 50% on final delivery.
  • Invoices are due on receipt unless we agree otherwise. Late payment may pause the work and may incur interest.
  • Fees are not refundable once production has started, unless the proposal says otherwise.
  • Work beyond the agreed scope, including extra rounds of changes, is quoted and invoiced separately.

Confidentiality

We keep what you share with us confidential, including footage, brand material, unreleased product details and internal messages, and disclose it only with your consent, when the work requires it, or when the law requires it. This continues after the project ends.

No guaranteed results

We do the work with reasonable skill and care, but we cannot promise particular results such as views, sign-ups or conversions. We are not responsible for the rules or decisions of platforms such as YouTube, Vimeo, LinkedIn or X, and the quality of the final film depends in part on the material we are given. Apart from what these terms and the proposal say, the work and the website are provided as they are.

Liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profit, data or opportunity. Our total liability for any claim is limited to the fees you paid for the project the claim relates to.

Indemnity

You agree to cover our reasonable costs, including legal fees, if a claim arises because you broke these terms or because material you gave us infringes someone else’s rights.

Ending a project

Either of us may end a project with 14 days’ written notice, or straight away if the other breaks these terms and does not put it right within 14 days of being told, or becomes insolvent. You pay for the work done and costs incurred up to the end date. Advance payments for unfinished stages are not refundable.

Things outside our control

Neither of us is responsible for delays caused by events beyond reasonable control, such as natural disasters, war, pandemics, power or internet failures, or outages at the platforms we rely on.

Governing law

These terms are governed by the laws of the State of Wyoming, USA. If a dispute comes up, we will first try to settle it in good faith; if that fails, it goes to the courts of Wyoming, unless the proposal names another place.

Changes and the rest

We may update these terms and will post the new version here with a new effective date. A change does not alter a proposal already signed. If any part of these terms cannot be enforced, the rest still applies.
